Privacy Counsel (100%) [CLOSED]

For our client, a global biopharmaceutical company (focus on oncology) with a regional headquarter located in the Basel area and currently more than 8,000 employees worldwide, we are seeking immediately or by arrangement an „Associate Director, Privacy Counsel (100%)“:

 

Responsibilities:

  • Reporting to the Director, Privacy, Americas & EMEA, lead in a newly created role privacy legal matters outside the Asia Pacific (APAC) region, with special focus on the group’s US, European and new markets operations („Territory“)
  • Serve as the group’s lead specialist for privacy law matters in the Territory and play a critical role in leading the development and implementation of legal privacy strategies, particularly with regard to R&D functions
  • Work with other members of the group’s Legal and Compliance and IT teams on data privacy and security-related matters, incl. auditing and monitoring activities, investigations and data incident responses, responses to data subject requests, and the design of scalable technology solutions and tools to support the group’s continued growth with its existing operations in the US, Europe, and in new markets and regions
  • In coordination with members of the Legal Department, monitor and map requirements of existing and new privacy laws and enforcement actions, and propose changes to be implemented by Privacy Officer, in the Territory
  • Advise the business in the Territory on complex matters and questions related to interpretation and compliance with privacy legal requirements and internal privacy policies and procedures
  • Ensure effective coordination with APAC Privacy Team and members of the APAC Legal & Compliance on the implementation of the global privacy program
  • In collaboration with members of the Legal Department, advise Privacy Officer in the Territory on country privacy obligations, e.g., those related to interactions with privacy regulatory authorities, data subjects‘ rights; work councils; and data breaches
  • Act as center of excellence and escalation point for contracts in the Territory. Counsel the business incl. R&D functions on privacy legal matters related to data processing agreements, data privacy addendums and clauses for MSAs, MCONs, CTAs, international data transfer agreements, and Privacy and security clauses for global, regional and country ICFs and Protocols
  • Draft regional templates of data privacy clauses, privacy notices and privacy consent forms to be deployed on a country level by the members of the Legal Department
  • Together with the Territory’s Legal department, localize regional templates into country or state templates
  • Make available playbooks, FAQs, and standard responses to EC/DPA inquiries in the Territory
  • In collaboration with the Territory’s Privacy Officer, provide training on data privacy matters to business and colleagues in the Legal Department
  • In coordination with colleagues in the Legal Department, represent the group on regional and R&D industry forums related to privacy, e.g., International Pharmaceutical and Medical Devices Privacy Consortium (IPMPC)

 

Requirements:

  • Bachelor of law or equivalent degree; lAPP certifications such as CIPP/US, CIPP/IT or CIPP/M would be a plus
  • At least 6 years‘ work experience in privacy, with at least 4 in the bio-pharmaceutical industry and/or advising the bio-pharmaceutical industry in a nationally recognized law firm or consulting practice
  • Strong working knowledge and experience with privacy and data protection laws such as, e.g., GDPR, CCPA and HIPAA
  • Excellent written and verbal communication skills and presentation skills in English
  • Demonstrated ability to build and maintain solid relationships and connections across the group
  • Ability to work independently as well as collaboratively with enthusiasm and accountability
  • „Customer First“ customer service orientation – puts the customer at the center of all business activities
